Terms and Conditions Agreement
Please read these Terms of Service carefully as they contain important information regarding your legal rights, remedies, and obligations. By agreeing to the terms and conditions agreement, you agree to be bound by the internal policies of EZZE.
Ezze is owned and operated by Ezze Technology (“Company” “we”, “us”, “our” and “Ezze”).
Ezze provides an online car-sharing platform that connects Vehicle Owners (“Hosts”) with those who want to rent the Vehicles (“Guests”) within the United Arab Emirates (UAE). Vehicles includes all vehicles that can legally be driven on public roads including, without limitation, cars, vans, buses and motorcycles, hereinafter collectively referred to as “Vehicles” and each as a “Vehicle”.
These terms and conditions (“Terms”) set out the basis upon which you (as a “User”, “you”, “your” and “Host” and/or “Guests” as the case may be) can access and use the Ezze website (“Website”) by way of a computer system (including Google/Facebook), mobile device or through a mobile application provided by Ezze (“Services”)
Ezze Host Terms set out the terms and conditions that apply to Hosts who make their Vehicle available to rent and are detailed in Section A to the Terms.
Ezze Guest Terms set out the terms and conditions that apply to Guest who books and rents the Vehicle from the Host and are detailed in Section B to the Terms.

Section A: General Terms
Section A of the Terms sets out the general terms and conditions that apply to each of Ezze’s Hosts and Guests.
1.1. By accessing and using the Services, you agree to be bound by these Terms, the Privacy Policy, and the Cancellation policy terms. If you do not agree with any of the Terms, you may not use the Services.
1.2. We may amend these Terms at any time by posting an updated version of the same. We encourages you to check the Terms regularly for any amendments to the Terms. Your continued use of our services will constitute your express consent to the then current version of the Terms.
1.3. Nothing in these Terms affects your statutory rights, either as a consumer of services or otherwise.
1.4. “Ezze Technology” maintains the www.ezzecar.com Website (“Site”).
2. PRIVACY POLICY
2.1. The terms of the Privacy Policy are found in Ezze’s privacy policy.
3. MEMBERSHIP
3.1. You must register as a User in order to access and use the Services, whether you are a Host or a Guest. On your registration as a User, we will create a profile for you based on the information you submit. If you link your Facebook account, your Facebook information will be used. In applying to be a registered as a User:
3.1.1. you must be at least 18 years of age; and
3.1.2. you must provide true, accurate, complete and current information (including, without limitation, your name, date of birth, email address, residential/postal address credit card details, and other details), as well as your current and fully valid Emirates ID/passport copy and driving license, as requested by Ezze during account creation on the Website. Ezze may request additional information from you in order to register you as a User and your registration as a User will be subject to providing any such additional information to Ezze.
3.2 Minors under the age of 18 shall are prohibited to register as a User of this website and are not allowed to transact or use the website
3.3 By registering yourself as a User on Ezze, you warrant that the details you provide to Ezze are correct and complete, at all times, and you agree that you will inform Ezze immediately of any changes to those details (e.g. change of email address). If you are registering as a User on behalf of a business or any corporate body, you are confirming that you hold the appropriate authority to bind the business or corporate body on whose behalf you are registering. You can access and update your details (excluding your name and last name) using the “My Account” area of the Website.
3.4 You authorize us to use any information provided to us in registering as a User to verify your information (including any updated information), to obtain credit reports about you from time to time while you are registered, and to obtain an initial credit authorization from your credit card issuer at the time of registration, if need be. You must hold a reputed bank credit card issued in your name that is accepted by Ezze and you must register that credit card with us, and your application for registration must otherwise be acceptable to Ezze in its own absolute discretion.
3.5 We take reasonable care to ensure that our Services are secure, and our payment gateway suppliers will be the only entities that will be collecting and using your financial information. All credit card transactions on our Services are processed using authorized providers, which includes MasterCard and Visa, and a secure online payment gateway that encrypts your card details in a secure host environment. The payment gateway providers will securely store your credit card details on their systems. These details will be fully encrypted and only used to process card transactions, which you have initiated. If you have any issue with your payment, please notify us and we will put you in contact with our payment gateway supplier.
3.6 The cardholder must retain a copy of transaction records and Merchant policies and rules.
3.7 We accept payments online using a Visa and MasterCard credit/debit card in AED (or any other agree currencies).
3.8 You are responsible for maintaining the confidentiality of your Username and password and for preventing unauthorized access to your profile. You agree to accept responsibility for all activities that occur under or in relation to your account. Please take all necessary steps to ensure that the Username and password is kept confidential and secure at all times. Please inform Ezze immediately if you have any reason to believe that your Username and/or password has become known to anyone else, or is/are being, or are likely to be, used in an unauthorized manner.
3.9 There can only be one account per User, even where a User is a corporate body.
3.10 Ezze reserves the right to refuse access to the Website, terminate accounts, remove or edit content, or cancel orders at Ezze’s sole discretion and without the requirement to notify you.
4. BOOKING
4.1. By registering with Ezze, Guests gain access to a wide variety of Vehicles, which they can choose from based on price, model, size, and other requirements and accordingly enter into a rental agreement with the Host for the rental of a Vehicle on the Terms (“Booking”).
4.2. There will be two categories of Hosts: private vehicle Owners called “Private Hosts” and Car Rental companies called Commercial Hosts. There will be two categories of Guests: UAE residents renting Vehicles (“Resident Guests”) and non-UAE residents renting Vehicles (“Tourist Guests”). A Resident Guest will hold a valid Emirates ID and UAE driving license. Resident Guests may rent Vehicles from Private and Commercial Hosts, whilst Tourist Guests may only rent from Commercial Hosts.
4.3. If the Guest wishes to rent a certain Vehicle, he/she can make a Booking by agreeing to the Terms.
5.1. The prices relating to the Services (“Fees”) will be displayed in United Arab Emirates Dirhams (AED) with 5% VAT applicable to the Fees and are set out in the Schedule of Fees.
5.2. When you make a Booking, Ezze collects certain personal and transactional information (e.g. name, address, email address). Ezze’s use of your information is detailed in these Terms.
5.3. You may pay the Fees for the Booking that you make by supplying your credit card details via the secure online order form on the Website. Ezze does not accept any other modes of payment for its Services.
5.4. When you make your Booking, Ezze’s system automatically asks your card issuer for authorisation for the transaction amount. If Ezze gets a valid authorisation, your card issuer will hold this value expecting a charge from Ezze. The receipt of your credit card details and debit of payments does not constitute Ezze’s acceptance of your Booking.
5.5. Bookings will be accepted subject to availability and confirmation by the Host. We may not accept your Booking in a variety of situations, including:
5.5.1. if your Booking is in your wishlist/basket on the Website, but has not yet been paid for;
5.5.2. if the Vehicle is unavailable;
5.5.3. if we are unable to obtain authorisation for your payment;
5.5.4. for any other reason (at our sole discretion).
We are not liable to provide you with any further information covering the reason(s) why we have not accepted your Booking.
5.6. We will not process your payment (or will cease processing your Booking) in these types of situations, and will not be liable to you or to any third party by reason of our decision to decline processing, or unwind or suspend any Booking after processing has begun. We reserve the right to refuse service, terminate your account, or cancel a Booking, at our sole discretion.
5.7. If you use the Services to make a Booking, you agree to pay the full amount payable for such Booking as indicated during the Booking request process. If the issuer of your credit card refuses to authorise payment, we will cancel your Booking and contact you for re-payment. We cannot be held responsible if this results in a delay regarding your Booking.
5.8. Once the Booking has been made and payment has been received successfully, we will send you an email confirming the Booking, and receipt of payment.
5.9. Please do not send to Ezze any payment information using email, WhatsApp, SMS, over the phone or any other social media portals. Ezze cannot guarantee the security of any payment information communicated via any of these channels and will not be liable to you for any losses caused as a result of unauthorised access to any of these channels.
6.1. Ezze grants you a limited, non-exclusive, non-transferable, and revocable license to use the Services for their intended purposes subject to your compliance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Services. Unless such restriction is prohibited by law or you have our written permission, you may not reverse engineer or attempt to extract the source code of the Services. You may only access the Services through the interfaces that we provide for that purpose (for example, you may access the Services via the Website; you may not “scrape” the Services through automated means or “frame” any part of our Services), and you may not interfere or attempt to disrupt our Services.
6.2. Some parts of our Services may allow you to upload or submit content (such as text, images, video, lists, links, and other materials). You retain all rights in any content that you upload or submit and are solely responsible for that content. You grant Ezze a non-exclusive, royalty-free, worldwide, transferable, sub-licensable license to use, store, publicly display, publicly perform, reproduce, modify, create derivative works from, and distribute any such content, including any Feedback, for the purposes of operating, providing, and improving the Services. Ezze may, in its sole discretion, remove or take down any content, including any Feedback that you upload or submit to the Services, for any reason, including breach of these Terms.
6.3. You may have the option of accessing the Services through a downloadable software and this software may update itself automatically on your device. [Some software or portions of the software, in our Services may be governed by open source licenses. In that case, we will make such licenses available to you and, in the case of conflict between such a license and these Terms, the open source license will control, but only with respect to the software, or portion of the software, to which it applies].
6.4. If you are using Ezze on behalf of a business or other entity, you represent and warrant that you have the necessary authority to bind that business or entity to these Terms and that you are agreeing to these Terms on behalf of that business or entity.
6.5. We are constantly modifying and improving our Services. We may introduce new features, change existing features, or remove features from the Services at any time and without notice. If you provide us with any Feedback on or other comments regarding the Services, you grant Ezze the right, on an unlimited, perpetual basis, to use such Feedback or other comments for any purpose without restriction or payment to you.
7. EZZE’S ROLE
Ezze is neither the Host or the Guest of the Vehicles. Ezze is only a facilitator providing a communication platform between Hosts and Guests to provide Services in accordance with these Terms. Arrangements as to the delivery and pickup of Vehicles are made solely between the Host and Guest, without Ezze’s involvement. Accordingly, the rental agreement formed through the completion of a Booking using the Services is also solely between the Host and Guest. The enforcement of any contractual obligations arising out of the Booking using the Services is the responsibility of the Host and the Guest as the sole parties to that Booking. Ezze shall not be responsible in any manner whatsoever with respect to the Booking or any claims or dispute which might arise between Hosts and Guests relating to such Booking. Furthermore, Ezze is not obliged to mediate between Hosts and Guests with regard to their use of the Services, which is at their own risk. Subject to the Terms, the Host and Guest shall resolve any subsequent dispute directly with each other. In the event of non-resolution of disputes, either Host or Guest may recourse the matter to Ezze, to where Ezze may provide sufficient supplementary evidence that could later be used in the involvement of Abu Dhabi Courts
7.1. You hereby irrevocably release Ezze (and our officers, directors, affiliates, employees and agents) from any damages or claims (including consequential and incidental damages) of every kind or nature, suspected and unsuspected, known and unknown, and disclosed or undisclosed, arising out of or in any way connected with such disputes and your dealings as Hosts and Guests. You shall indemnify and keep Ezze and its affiliates (and their respective employees, directors and representatives) against any claim or action or damages in relation to such dispute and/or your dealings as Host or Guest.
8. EZZE’S RESERVATION OF RIGHTS
8.1. Ezze retains the right, in its sole discretion, to immediately cancel any Booking; prevent or restrict access to the Services; or take any other action to restrict access to or availability of or remove any objectionable material, Feedback, ratings, inaccurate listings, inappropriately categorized items, unlawful items or items prohibited from listing using the Services under these Terms. Ezze reserves the right and has absolute discretion, but not an obligation, to remove, screen or edit any content, including Feedback, that breaches these provisions or is otherwise objectionable. Ezze reserves the right to refuse listings of any Vehicles, or immediately remove any listings, where Ezze objects to how you identify yourself using the Services (including, but not by way of limitation, your name, branding or marks) and/or if you are otherwise making inappropriate use of your domain name.
8.2. Ezze reserves the right to initiate legal proceedings against any Users for fraudulent use of the Services and any other unlawful act or acts of omissions in breach of these Terms.
9. INTELLECTUAL PROPERTY
9.1. Unless otherwise expressly stated, all contents of the Services are copyrights, trademarks, patents and/or other intellectual property owned, controlled or licensed by Ezze or one of our affiliates or by third parties who have licensed their materials to us and are protected by all applicable laws.
9.2. We, together with our licensors, expressly reserve all intellectual property rights in all text, programs, products, processes, technology, content and other materials, which appear on the Services. Access to the Services does not confer and shall not be considered as conferring upon anyone any license under any of our or any third party’s intellectual property rights. Any use of the Services or its contents, including copying or storing it or them in whole or in part, other than for your own personal, non-commercial use, without our permission is prohibited.
10. DISCLAIMER OF WARRANTY
10.1. Services are provided on an “as is” and “as available” basis. Ezze and its affiliates, and our and their respective suppliers, and any of our and their officers, directors, managers, members, agents, and employees, expressly disclaim (to the fullest extent permitted by applicable law) any and all express, implied, and statutory warranties, including, without limitation, any warranties of merchantability, fitness for a particular purpose, freedom from computer virus, title, and non-infringement of proprietary rights.
10.2. In addition, Ezze makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the Services or the Booking. You agree that the entire risk arising out of your use of the Services, any Booking or any other services requested by you or delivered to you, remains solely with you.
10.3. Ezze makes no warranty that the Services: (a) will meet your requirements or expectations; (b) will be available on an uninterrupted, timely, secure, or error-free basis; or (c) will be accurate, reliable, free of viruses or other harmful code, complete, legal or safe. The Services may be subject to limitations, delays and other problems inherent in the use of the internet and electronic communications. Ezze is not responsible for any delays, delivery failures or other damages resulting from such problems.
11. LIMITATION OF LIABILITY
11.1. To the maximum extent permissible by applicable law, Ezze and its affiliates, and our and their respective suppliers, and any of our and their officers, directors, managers, members, agents, and employees:
11.2. are not liable for any direct, indirect, punitive, incidental, special, or consequential damages or loss (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) arising out of, or in a way connected with the use or inability to use the Services and its content, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not Ezze is advised of the possibility of such damages; and
11.2.1. exclude any and all liability for damages caused by, any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any communications due to technical problems or traffic congestion on the internet or on the Services or combination thereof, including any injury or damage to any users or to any person’s computer related to or resulting from use of the Services;
11.2.2. In relation to any Host, any damage to the Vehicle by the Guest;
11.2.3. In relation to any Guest, are not liable for any loss or damage to property due to any fault or defect in a Vehicle rented out by a Host, all risks of damages or injury, including death.
11.3.Where it is not possible to exclude liability under applicable law, you agree that the maximum liability of Ezze and its affiliates, and our and their respective suppliers, and any of our and their officers, directors, managers, members, agents, and employees for any corresponding claim shall be limited to an amount of AED 100.
12. INDEMNITY
12.1. You hereby agree to hold harmless and indemnify Ezze and its affiliates, and our and their respective suppliers, and any of our and their officers, directors, managers, members, agents, and employees, from and against any claims, liabilities, suits, judgments, litigation costs, causes of action, demands, recoveries, losses, damages (actual and consequential), fines, penalties, and attorneys’ fees or other costs or expenses of any kind or nature arising from or in any way related to your use of the Services, including, but not limited to those brought by you or on your behalf in excess of the liability described above, or by third parties as a result of your breach of these Terms, your violation of any law or the rights of a third party, and/or your use of the Website and/or the Services.
13. ELECTRONIC COMMUNICATIONS
13.1.To fulfill our obligations to you under these Terms, we may wish to communicate with you by email and/or by posting notices via our Services. You agree to receive communications from us electronically, and these electronic communications will satisfy any legal requirement for communications which need to be in writing.
Section B: Host Terms
Section B of the Terms sets out the specific terms and conditions that apply to Hosts.
1.1. If you wish to use the Services to rent out your Vehicle as a Host, you must belong to one of the following two categories: individuals (Private Hosts) or car rental companies (Commercial Hosts), You must be a registered User and you must register your Vehicle (“Registered Vehicle”) by providing:
1.2. a complete and accurate description of the Registered Vehicle that is not misleading, with such description including details of any material defects or deficiencies with the Vehicle;
1.3. specify the Host Fee for the period of the rental of the Vehicle from pick-up time to drop -off time (which may vary depending on the Booking) (each a “Rental Period”), it being acknowledged that the rental price that will be displayed for a Registered Vehicle will be the Host Fee, plus Ezze’s commission (“Ezze Fee”) plus 5% VAT (together the “Rental Price”);
1.4. specify a proposed pick-up location and proposed drop-off location.
2. You must not register a Vehicle as a Registered Vehicle unless:
2.1. it has a current UAE vehicle licence;
2.2. you have a current, valid, and existing, comprehensive insurance policy in place covering the Registered Vehicle(s) and including terms which allow you to make your Vehicle available as a Registered Vehicle to Guests in accordance with the Terms;
2.3. you own the Registered Vehicle or otherwise have the right to register the Registered Vehicle as contemplated by these Terms.
2.4. If, at any time after being registered, the Vehicle no longer meets the above requirements, you must remove the Vehicle from your profile and no longer accept any Booking requests for that Vehicle.
2.5. You acknowledge and agree that:
2.5.1. you may update the Host Fee at any time, subject to Ezze approval, although any Host Fee included as a part of the Rental Price on a Booking that you have accepted cannot be changed;
2.5.2. you may update the proposed pick-up location and proposed drop-off location at any time prior to the Bookings;
2.5.3. no further changes can be made after the booking confirmation and that you shall contact Ezze as soon as practically possible for situations beyond your control;
2.5.4. you must update the Registered Vehicle details and description immediately if they change.
2.6. You warrant to us that the Registered Vehicle matches, and will continue to match, the description you have provided at all times whilst listed on the Services and during any Rental Period.
3. BOOKING PROCEDURE FOR HOSTS
3.1. The following procedure will apply in relation to the acceptance of a Booking by a Host:
3.1.1. Hosts may make their Registered Vehicle available for rent using the Services, specifying the time periods during which the Registered Vehicle is available to rent in accordance with the availability procedures set out on the Services;
3.1.2. on receipt of details of the Booking request, you may, at your sole discretion, choose to accept or decline to rent your Registered Vehicle to a Guest who has submitted the Booking request. If you accept a Booking request, you acknowledge and agree that this will, subject to clause (c), Instant bookings can also be enabled, this means that a guest will have the ability to get instant confirmation on his/her booking without having to wait for host approval, subject to clause (c)
3.1.3. Upon a confirmation of the booking whether instantly or by you as a host, it is binding as a Booking on both the Host and the Guest, and subject to the cancellation fees rolled out in the fees and fines table;
3.1.4. upon confirmation by the Host or instant confirmation booking, a Booking confirmation will be issued by Ezze to the Host and the Guest;
3.1.5. the Host, not Ezze, is solely responsible for honoring any confirmed Booking and making the Registered Vehicle available to the Guest to satisfy the Booking.
4.1. Subject to Ezze Cancellation policy and without limiting clause 3.4, you may cancel a Booking via the Services:
4.1.1. subject to payment by you of the applicable cancellation fee (as specified in the Cancellation Policy), at any time before the commencement of the Rental Period.
4.2. Subject Ezze Cancellation policy and to clause 3.4, as part of a Booking:
4.2.1. if you fail to make the Registered Vehicle available at the pick-up location within 60 minutes after the start of a Rental Period; or
4.2.2. if the Guest determines (acting reasonably) that the Registered Vehicle is materially different from the description of the Registered Vehicle on the Services, you will be deemed to have failed to complete a Booking and considered as “a host no show” and must pay the applicable fees according to the Ezze fees and fines table .
4.3. We may terminate your registered User account if you repeatedly cancel Bookings.
4.4. You may cancel a Booking without the need to pay a cancellation fee if you meet the Guest at the pick-up location at the commencement of a Rental Period and the Guest is, in your opinion (acting reasonably), unfit to drive at the commencement of the Rental Period, including due to intoxication.
4.5. You may cancel a Booking without the need to pay a cancellation fee If the credit or debit card provided by the guest couldn’t process the deposit specified by you in your host rules.
4.6. If you cancel the Booking in accordance with clause 3.4 and/or clause 3.5 above, you will not need to pay a cancellation fee and you will still receive the Host Fee if:
4.6.1. you notify us immediately of the cancellation and inform us of the reason you cancelled the Booking; and
4.6.2. upon reasonable enquiry, we verify that the reason you cancelled the Booking was reasonable in the circumstances.
5. RENTAL
5.1. For each Booking of a Registered Vehicle of which you are the Host, you agree:
5.1.1. to make the Registered Vehicle available for rent to the Guest for the Rental Period; and
5.1.2. that the Guest will have exclusive use of the Registered Vehicle for the Rental Period.
5.2. The Guest may request the Host to extend the initial Rental Period for an extended Rental Period provided the Registered Vehicle is available to rent during those times. Neither the initial Rental Period nor any extended Rental Period, whether individually or combined, may be more than 90 days.
5.3. The Guest must inform the Host in advance with regard to the extended Rental Period and prior consent must be obtained from the Host. In any case, the Guest must inform Ezze of the extended Rental Period agreed with the Host prior to the expiry of the initial Rental Period by making an extension through the Ezze platform.
5.4. Host shall be responsible for the normal service, repair, fair wear and tear and to provide the Guest with another vehicle for temporary use while repairing the vehicle if any such scenarios arises during an extended Rental Period.
5.5. Host shall be responsible for providing professional services to its Guests as they are obtained through the Ezze Platform. Host shall endeavor to settle amicably any disputes directly with the Guests.
6. VEHICLE HANDOVER PROCEDURE
6.1. The following procedure will apply in relation to the handover to a Guest as part of a Booking of a Registered Vehicle of which you are the Host:
6.1.1. you must meet the Guest at the pick-up location at the commencement of the applicable Rental Period with the booked Vehicle;
6.1.2. you must not make any representations to the Guest on behalf of Ezze;
6.1.3. you must ensure that the Registered Vehicle continues to meet the requirements under clause 1 of Section A (Host Terms) for the duration of the Rental Period. You must ensure that the Registered Vehicle, at the start of the Rental Period:
6.1.3.1. is in a roadworthy, serviceable and safe condition;
6.1.3.2. has a spare tyre that is roadworthy and inflated;
6.1.3.3. has a jack and tyre replacement tools;
6.1.3.4. has all required vehicle fluids, transmission, oil, coolant, brake and power steering, and fluid and wiper wash at a satisfactory level to last the duration of the Rental Period;
6.1.3.5. has a full tank of fuel;
6.1.3.6. is reasonably clean;
6.1.3.7. does not contain any of your personal belongings;
6.1.3.8. shall be in compliance with the RTA regulations.
6.2. You must, prior to providing the Registered Vehicle to the Guest:
6.2.1. ensure that the Guest presents to you a driving license issued to the Guest that is valid and current for the full duration of the Rental Period and that is appropriate for the booked Vehicle. Please see list of countries whose driving license is recognized https://www.rta.ae/wps/portal/rta/ae/home/rta-services/service-details?serviceId=3704306 in the UAE. The UAE does not recognize driving licenses from any country that is not on this list. This list will be updated by Ezze from time to time and you should check this list before any Booking. You must not retain the Guest’s driving license, their passport or any other Guest documentation (including any credit cards) at any time during the Rental Period.
6.2.2. photograph the Registered Vehicle, clearly documenting the condition of the Vehicle. You also hereby grant the Guest the right to photograph the Registered Vehicle for the limited purpose of documenting the condition of the Registered Vehicle, both at pick-up and at drop-off in accordance with the Terms.
6.3. It is your responsibility to ensure that you take all necessary steps to record clear and reliable evidence to prove the condition of the Registered Vehicle at the commencement of the applicable Rental Period.
7. VEHICLE RETURN PROCEDURE
7.1.1. At the end of each Rental Period for a Registered Vehicle of which you are the Host:
7.1.1.1. You must be available to collect your Registered Vehicle at the drop-off location at the end of the Rental Period; you must photograph the Registered Vehicle noting any areas of damage, if any.
Section C: Guest Terms
1.1. If you wish to use the Services to make a Booking to rent a Registered Vehicle for your own use, you must be a User and you must upgrade your profile to Guest-verified status. To upgrade to Guest-verified status, you must provide us with true, accurate, complete and current information (including name, date of birth, email address, credit card details, and other details), as well as your current and fully valid National ID/passport copy and driving license, and upload both documents to the Services. We may, at our discretion, ask you for other information/documentation and the upgrade of your profile to Guest is subject to you providing any such additional information to us.
1.2.Please see list of countries whose driving license is recognized within the UAE https://www.rta.ae/wps/portal/rta/ae/home/rta-services/service-details?serviceId=3704306. The UAE does not recognize driving licenses from any country that is not on this list. To be a Guest, make a Booking and drive a Registered Vehicle, you must hold a driving license from one of these countries. This list may be updated, from time to time, and you should check the list before making any Booking.
1.3. You can only rent a Registered Vehicle that is intended to be driven by you for the Rental Period and for which you are licensed to drive in accordance with your driving license(s).
1.4. If, at any time after becoming a User, your driving Licence expires, is suspended or is revoked, you must notify us immediately, cancel any current Bookings, and not make any further Bookings until such time as you hold a current and valid driving license.
2. CANCELLATION OF A BOOKING
2.1. Without limiting clause 2.4 below, and subject to Ezze Cancellation policy you may cancel a Booking at any time before the commencement of the Rental Period, in which case you will receive a refund of the Rental Price less the applicable cancellation fee(s) as detailed in the Cancellation Policy.
2.2. If you:
2.2.1. fail to collect the Registered Vehicle you have booked at the pick-up location within 120 minutes after the start of a Rental Period; or
2.2.2. the Host determines (acting reasonably) that you are unfit to drive at the commencement of the Rental Period, including due to intoxication, you will be deemed as “a guest no show” and clause 2.3 below will apply.
2.3. Subject to clause 2.5 below, you will be subject to the “guest no show” fee rolled in cancellation policy and you will have to pay the fines rolled out in the fees and fines table ;
2.4. We may terminate your User account if you repeatedly cancel Bookings.
2.5. You may cancel a Booking without the need to pay a cancellation fee if you meet the Host at the pick-up location at the commencement of a Rental Period and the Registered Vehicle is, in your reasonable opinion, materially different from the description of the Registered Vehicle on Ezze.
2.6. Where you cancel the Booking in accordance with clause 2.5 above, you will not need
2.6.1. to pay a cancellation fee and you will receive a refund of the Rental Price if:
2.7. you notify us immediately of the cancellation and inform us of the reason why you cancelled the Booking; and
2.8. upon reasonable enquiry, we verify that the reason you cancelled the Booking was reasonable in the circumstances. If the Host cancels his or her Booking with us, we will refund you the Rental Price. You are not entitled to receive any part of any cancellation fee that may be charged to the Host in such circumstances. Refunds will be done only through the Original Mode of Payment.
3. RENTAL
3.1. For each Booking where you are the Guest, you agree:
3.1.1. to rent the Registered Vehicle from the Host for the Rental Period and for the Rental Price as specified in your Booking;
3.1.2. only You will be allowed to drive the Vehicle.
3.2. The Guest may request the Host to extend the initial Rental Period for an extended Rental Period provided the Registered Vehicle is available to rent during those times. Neither the initial Rental Period nor any extended Rental Period, whether individually or combined, may be more than 90 days.
3.3. The Guest must inform the Host in advance with regard to the extended Rental Period and prior consent must be obtained from the Host. In any case, the Guest must inform Ezze of the extended Rental Period agreed with the Host prior to the expiry of the initial Rental Period by making a booking extension through the Ezze platform.
4. PRICING AND PAYMENT
4.1. You must pay the Rental Price by credit card as part of the Booking request process
before a Booking is made. The Rental Price is inclusive of 5% VAT.
4.2. You agree to pay any additional fees listed in the fees and fines table or other costs incurred in connection with the Booking including but not limited to Salik and Parking Fees. The host may directly invoice you for any additional fees or other costs and they will be settled via your registered payment method, this settlement may happen outside the App. The additional fees will be inclusive of 5% VAT.
5. ACCIDENTS AND DAMAGE
5.1. If the Registered Vehicle is damaged during the Rental Period, you must report the
damage to the Host and Ezze immediately.
5.2. Without limiting clause 5.1, if the Registered Vehicle is involved in an accident during
the Rental Period, you must:
5.2.1. make the Registered Vehicle secure and inform the Police immediately;
5.2.2. record the car license number of any other vehicles involved and the name and address of any other drivers involved;
5.2.3. record the name and address of any witnesses;
5.2.4. not make any admission of liability or agree any settlement arrangement (including the payment of any monies) relating to the accident and/or the damage.
5.3. You must not arrange or carry out any repair work to the Registered Vehicle; you must go through the necessary insurance process in the event of the Vehicle sustaining any damage, or upon discovering that part of it is faulty. In the event, you arrange or carry out the repair yourself, then you shall be liable to compensate the Hosts in accordance with the claims raised by Hosts.
6. YOUR LIABILITY
6.1. In respect of a Booking, you will be liable for:
6.1.1. any loss of, or damage to, the Registered Vehicle;
6.1.2. any consequential damage, loss or costs incurred by us or the Host, including salvage costs and any damages or costs we must pay to the Host and/or;
6.1.3. any loss of, or damage to, property of any third party.
